The City Council appoints the city attorney to serve as chief legal adviser to the council, city manager, operating departments, and commissions. The city attorney focuses on the legal options and risks associated with city actions, and drafts necessary legal documents, ordinances, resolutions, contracts, and other documents. The city attorney oversees all civil actions and proceedings to which the city is a party, retaining special counsel if necessary, and prosecutes enforcement actions involving the Saratoga Municipal Code.

The City of Saratoga receives legal services through contract with the firms of Shute, Mihaly and Weinberger LLP, and Wittwer and Parkin LLP, which represent cities throughout California.
